Thailand — crypto regulation
Status: legal · Last reviewed 2026-11-05
Crypto is legal and licensed by the SEC under the Emergency Decree on Digital Asset Businesses (2018), amended in April 2025 to cover foreign platforms that solicit Thai users. Crypto cannot be used as a means of payment, but the TouristDigiPay sandbox (Aug 2025) lets foreign visitors convert crypto to baht for spending. Gains on SEC-licensed exchanges, brokers and dealers are exempt from personal income tax from 2025 to 2029. In 2026 the regime moved into market-building: the Cabinet approved crypto as an underlying for TFEX derivatives (Feb 2026) and 11 SEC notifications allowing SET-listed spot Bitcoin and Ether ETFs took effect on 16 Oct 2026.
