Romania — crypto regulation
Status: partial · Last reviewed 2026-11-05
MiCA applies in Romania, but Romania has no national MiCA implementing act and no designated competent authority. ASF said on 5 Jul 2026 that it cannot receive or decide MiCA authorisation applications, and the government's draft MiCA emergency ordinance (first reading 2 Apr 2026, naming ASF and BNR) stalled after the government fell in May 2026. Since the transitional period ended on 1 Jul 2026, users can rely only on CASPs passported from other member states; ESMA's register lists no Romanian CASP. Individuals' crypto gains are taxed at 16% from 1 Jan 2026 (up from 10%), and crypto providers must report users' transactions to ANAF starting with 2026 income.
