Status: legal · Last reviewed 2026-11-05
MiCA member state, with CONSOB and the Bank of Italy as dual national competent authorities. Legislative Decree 129/2024 transposed MiCA with criminal penalties for unlicensed services. The OAM-register transitional regime expired on 30 June 2026, so from 1 July 2026 only MiCA-authorised CASPs may serve Italian clients. CONSOB actively flags unauthorised firms on ESMA's non-compliant register. The crypto capital gains tax rose from 26% to 33% in 2026, and market abuse fines reach EUR 5M.
